No tax or legal advice

Residay is an information and record-keeping tool. Nothing on this website, in the calculators, or in the app is tax, legal, immigration or financial advice, and no professional relationship arises from using it. Residency and immigration outcomes depend on facts a day counter cannot observe — homes, intentions, employment arrangements, domicile, treaty positions — and on your particular circumstances.

The calculators

The calculators run entirely in your browser and compute a result from the dates you enter. They are provided as-is. A result reflects only the information you supplied and the rule version in force at the time; it is not a determination of your residency, immigration or tax status. We take care to encode rules correctly and test them against published worked examples, but we do not warrant that any result is accurate, complete or suitable for your situation, and we accept no liability for decisions taken on the basis of one.

Rule data licence

We publish our rules knowledgebase as JSON at /rules/index.json. Because we would rather this data be quoted correctly than not at all, it is offered under a permissive licence.

• Licensed under CC BY 4.0 (https://creativecommons.org/licenses/by/4.0/): the rule files served from /rules/ — thresholds, counting conventions, parameters, source links, verification dates and version metadata. You may use, adapt and redistribute them, including commercially, provided you credit Residay — residay.com.
• All rights reserved: our golden test fixtures, the written guides, articles and explanatory prose on this site, the rule schema and interpretation notes, the Residay name, wordmark and visual identity, and the software itself. These are not covered by the licence above.

We assert database rights in the knowledgebase as a compilation, including the sui generis database right under Directive 96/9/EC as applicable in Malta, arising from the investment in obtaining, verifying and presenting its contents. Systematic or repeated extraction of substantial parts of the knowledgebase, or of the fixtures, for the purpose of building or operating a competing product or service is not permitted.

Acceptable use

Use the website lawfully. Do not attempt to disrupt it, and do not scrape it in a way that degrades service for others — the rules endpoints exist precisely so that automated access does not need to be rude.

Availability and changes

The website is provided without any guarantee of availability. Rules change, and we update or version them as they do; a page reflects the position as at its stated review date and may not reflect subsequent changes. We may update these terms, and the date above will change when we do.

Liability

To the fullest extent permitted by law, we exclude liability for loss arising from use of the website, the calculators or the published data, including any tax, penalty, interest or immigration consequence. Nothing here excludes liability that cannot lawfully be excluded.

Governing law

These terms are governed by the laws of Malta, and the courts of Malta have exclusive jurisdiction, without affecting any mandatory consumer protections available to you where you live.
